Site-Wide Disclaimer

Last updated: January 2025

Important: All content on this website is provided solely for informational purposes and is not medical, health, safety, or compliance advice. We do not make any health claims. Our products are not intended to diagnose, treat, cure, or prevent any disease, and no statements have been evaluated by the Food and Drug Administration (FDA). Any descriptions of cleaner water, softer skin and hair, spot-free dishes, or extended appliance life refer only to aesthetic or operational outcomes, not health benefits, and results vary based on home conditions, water chemistry, usage patterns, and maintenance. References to contaminant reduction pertain only to components tested under controlled conditions according to the listed certifications; we do not remove all contaminants, and actual performance depends on water source, total dissolved solids, pH, flow rate, and filter service life. Any water testing we provide is strictly for screening and educational purposes; it does not constitute a certified compliance test. For regulatory or health-related water quality decisions, use a state-certified laboratory and comply with local or state health department requirements. Mentions of NSF/ANSI or other standards apply only to the individually certified components identified in the product specification sheets and do not imply whole-system certification or agency endorsement unless explicitly stated in writing. Testimonials and case studies reflect individual experiences or illustrative data and are not guarantees of similar results. No warranty or guarantee is made beyond those explicitly stated in our written warranty and these Terms of Service. To the fullest extent permitted by law, we disclaim all implied warranties and any liability arising from reliance on website content. We make no claim that our products comply with any federal, state, or local health standard or procurement regulation unless such compliance is expressly confirmed in writing for a specific product and model number. For health or medical questions, consult a physician or other qualified healthcare professional; for water quality compliance, consult your local water utility or state agency.

1. Agreement to Terms

By accessing or using this website, placing an order, or purchasing any product or service from PURE 365 INC, you agree to be bound by these Terms of Service, our Privacy Policy, and all applicable laws. If you do not agree, do not use this site or purchase our products.

2. Eligibility and Acceptable Use

You must be at least 18 years old and capable of forming a binding contract. You may not use this site for any unlawful purpose or in any way that violates these Terms. You agree not to submit false, misleading, or fraudulent information.

3. Products and Services

We sell water filtration, softening, and treatment systems and related products in the United States only. We do not ship internationally. All product descriptions, images, specifications, and pricing are subject to change without notice and do not constitute an offer until we confirm your order. We reserve the right to limit quantities, refuse service, or cancel orders in our sole discretion. Product specifications and certifications apply only to the components listed in writing. We make no health claims and no representation that products will meet any particular health standard or compliance requirement unless expressly confirmed in writing for a specific model.

4. Pricing, Orders, and Cancellations

Prices are stated in U.S. dollars and do not include applicable sales tax, shipping, installation, or additional fees unless stated. We reserve the right to correct pricing errors and to cancel or refuse orders placed at incorrect prices. Orders are not binding on us until we send you an order confirmation. You may cancel an order before shipment by contacting us; cancellations after shipment or installation may be subject to restocking fees and return conditions.

5. Payment Terms

Payment is due at the time of order or as otherwise stated in your invoice or agreement. We accept major credit cards, ACH, wire transfer, and checks (subject to clearance). For financed or third-party payment plans, you are responsible for all terms with the financing provider. Non-payment or chargeback disputes may result in service suspension, collection action, or legal proceedings. You are responsible for all collection costs, including reasonable attorney fees.

6. Delivery, Inspection, and Returns

Delivery timelines are estimates only. Title and risk of loss pass to you upon delivery to the carrier or to your designated location. Inspect all shipments immediately upon receipt and report damage or shortage within 48 hours. Returns of unopened, unused products in original packaging may be accepted within 30 days subject to a restocking fee; installed, used, or custom products are generally not returnable. Contact us for return authorization before shipping anything back.

7. Warranties and Disclaimers

Product warranties, if any, are limited to those expressly stated in your purchase documentation or the manufacturer's written warranty. We disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free website operation, product performance under all conditions, or compatibility with all water sources or plumbing configurations. The Site-Wide Disclaimer above is incorporated here by reference.

8. Limitation of Liability

To the fullest extent permitted by law, PURE 365 INC and its owners, officers, employees, contractors, and suppliers shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost data, personal injury, or property damage arising out of or related to your use of the website, any product, or any service, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid for the product or service giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above may not apply in full; in such cases, liability is limited to the maximum extent permitted.

9. Indemnification

You agree to indemnify, defend, and hold harmless PURE 365 INC and its owners, officers, employees, contractors, and suppliers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising out of or related to: (a) your use of the website or products; (b) your breach of these Terms; (c) your violation of any law or third-party rights; or (d) installation, modification, or maintenance of products by anyone other than our authorized personnel, unless you provide evidence of proper licensing and compliance.

You may not copy, reproduce, republish, upload, post, transmit, distribute, or create derivative works from any content without our prior written consent.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the website, or any product or service shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, and judgment on the award may be entered in any court having jurisdiction. The arbitration shall be conducted in Los Angeles County, California. Notwithstanding the foregoing, we may seek injunctive or other equitable relief in any court of competent jurisdiction to protect our intellectual property or confidential information. You waive any right to a jury trial and any right to participate in a class action or class-wide arbitration.

12. Changes to Terms

We reserve the right to update or modify these Terms at any time by posting the revised Terms on this page with a new "Last updated" date. Your continued use of the website or purchase of products after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.

14. Entire Agreement

These Terms, together with our Privacy Policy and any written order confirmation, purchase agreement, or warranty document we provide, constitute the entire agreement between you and PURE 365 INC regarding your use of the website and purchase of products, and supersede all prior or contemporaneous understandings, agreements, or representations, whether written or oral.

Installer and End-User Responsibilities

Last updated: January 2025

If you hire or contract with a third party to install, service, or maintain any water treatment equipment purchased from PURE 365 INC, you are solely responsible for:

  • Verifying licensure and qualifications. Confirm that the installer holds all required state contractor licenses (for example, in California, a valid C-55 Water Conditioning Contractor or C-36 Plumbing Contractor license, or both as applicable) and any other permits or certifications required by your city, county, or state.
  • Ensuring code compliance. The installer must perform all work in compliance with applicable building codes, plumbing codes, electrical codes, health and safety regulations, and manufacturer installation instructions.
  • Obtaining permits and inspections. Where required by local or state law, you or your installer must obtain the necessary permits and pass any required inspections before, during, or after installation.
  • Warranty and liability. Improper installation, modification, or maintenance by an unlicensed or unqualified person may void product warranties and may subject you to liability for property damage, code violations, or regulatory penalties. PURE 365 INC is not responsible for installation workmanship, permit compliance, or any damage arising from third-party installation or service.
  • Ongoing maintenance. Follow all manufacturer-recommended maintenance schedules, including filter and media replacement, sanitization, and system testing. Failure to maintain the system as directed may degrade performance, void warranties, and create health or safety risks.
  • Water testing and monitoring. Periodic water testing by a state-certified laboratory is recommended, especially if you rely on a private well or have specific health or regulatory concerns. Our products are designed to improve aesthetic water quality and reduce certain contaminants under normal operating conditions, but they are not a substitute for professional water quality testing or treatment prescribed by a health authority.

By purchasing and installing our products, you acknowledge that you have read, understood, and agreed to these responsibilities.
